The short version: Use BroCode to design and order custom apparel. Don't abuse the platform. All sales are final on custom printed items. You own your designs; we own ours. If something breaks, our liability is limited to what you paid us.
These Terms of Service ("Terms") constitute a legally binding agreement between you and BroCode ("BroCode," "we," "us," or "our") governing your use of the BroCode website at brocode.me and all related services (collectively, the "Platform").
By accessing or using the Platform, creating an account, using the AI design studio, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
You must be at least 13 years of age to use BroCode. By using the Platform, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Platform and that they have agreed to these Terms on your behalf.
You must be a human to use BroCode. Automated access by bots, scripts, or AI agents is prohibited unless explicitly authorized in writing by BroCode.
You may use parts of BroCode without an account, but an account is required to use the AI design studio, save designs, and place orders.
We reserve the right to suspend or terminate accounts that violate these Terms, create fraudulent orders, or abuse the Platform.
AI image generation is rate-limited to 3 images per 5 minutes per account to manage costs and prevent abuse. These limits may be adjusted from time to time. Attempting to circumvent rate limits (by creating multiple accounts, using automated scripts, or other means) is a violation of these Terms and may result in account termination.
You are responsible for the prompts you submit to the AI design studio. You agree not to submit prompts that would generate content that is:
We reserve the right to review generated content and remove any designs that violate these Terms. Repeated violations will result in account termination.
AI image generation is powered by our AI image generation service. Your prompts are sent to our AI image generation service to generate images. BroCode is not responsible for the outputs of our AI image generation service's models beyond our obligation to review and remove policy-violating content.
All AI-generated preview images displayed on the Platform contain a visible watermark. The clean, unwatermarked version of your design is used only for printing when you place an order. Attempting to circumvent, remove, or bypass watermarks — including through screen capture combined with redistribution — may constitute intellectual property infringement.
All prices are displayed in US Dollars (USD) and are inclusive of the base garment cost and a custom design surcharge. Prices do not include shipping or applicable taxes, which are calculated and displayed at checkout.
We reserve the right to change prices at any time. Price changes do not affect orders already placed and confirmed.
Discounts may be applied to orders meeting minimum quantity thresholds. Discount tiers are displayed during checkout and are subject to change. Discount abuse (e.g., splitting large orders to avoid minimum thresholds) may result in order cancellation.
Payments are processed by our payment processor By placing an order, you agree to our payment processor's terms of service. BroCode does not store your payment card information. A charge appears on your statement as "BroCode" or "BROCODE.ME."
Placing an order constitutes an offer to purchase. An order is accepted and a binding contract formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order for reasons including product unavailability, errors in pricing or product descriptions, or suspected fraud.
All BroCode products are printed on demand. This means each item is produced specifically for you after your order is placed.
Production and fulfillment is handled by our order fulfillment center Our fulfillment partner's production standards apply. BroCode is not responsible for production delays caused by events outside our control, including natural disasters, carrier disruptions, or supply chain issues.
All sales are final on custom printed items. Because every BroCode item is printed on demand specifically for you, we cannot accept returns or exchanges for change of mind.
If your item arrives defective, damaged, or materially different from what you ordered, we will replace it or issue a refund. To qualify:
BroCode is not responsible for dissatisfaction with the artistic output of the AI design studio. AI-generated designs may not exactly match your mental image of your prompt — this is a characteristic of AI generation, not a product defect.
Orders may be cancelled only before they enter production. To request cancellation, email hello@brocode.me immediately after placing your order. Once production has begun, cancellation is not possible.
If tracking shows your package as delivered but you did not receive it, contact your local carrier first. If the issue is not resolved, contact us at hello@brocode.me within 7 days of the tracked delivery date and we will investigate.
You retain ownership of the creative prompts you submit and the designs generated from them. By using BroCode, you grant us a limited, non-exclusive, royalty-free license to store, process, watermark, and transmit your designs solely for the purpose of providing our services (displaying previews, printing your orders, and storing your design history).
You represent and warrant that your designs do not infringe the intellectual property rights of any third party. You are solely responsible for ensuring your designs do not incorporate copyrighted logos, trademarked imagery, or other protected content without appropriate authorization.
The BroCode name, logo, website design, software, Studio interface, and all content we create are owned by BroCode and protected by US and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our intellectual property without our written permission.
Designs in the BroCode curated design library are owned by BroCode. You may use them to create custom products for personal use. You may not reproduce or redistribute library designs independently of a BroCode product.
You agree not to use BroCode to:
Violations may result in immediate account termination and, where applicable, legal action.
THE PLATFORM AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not warrant that AI-generated designs will meet your specific expectations or requirements. Color reproduction on printed garments may vary from on-screen previews due to monitor calibration and print process characteristics.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BROCODE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO BROCODE IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
You agree to indemnify, defend, and hold harmless BroCode and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
You may close your account at any time by contacting us at hello@brocode.me.
We may suspend or terminate your access to the Platform immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or if we are required to do so by law.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and indemnification — will survive.
These Terms are governed by the laws of the United States and the state in which BroCode is incorporated, without regard to conflict of law principles.
Any dispute arising from or related to these Terms or your use of BroCode shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
If you are a consumer located in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this page and notify you by email or by a prominent notice on the Platform at least 14 days before the changes take effect.
Your continued use of BroCode after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may close your account.
